Please read these conditions carefully, bookings are made and accepted on the following conditions:

Contract and Booking

1.1 The contract for a short-term holiday rental will be between Arbennig Lodges ("we", the “Owner”) and the person making the booking, and all members of the holiday party (referred to as "you", the “Holidaymaker” or “Guest”) in the following booking conditions. The contract of hire is not effective until we have received the deposit, see section 3. The contract will be subject to these booking conditions and must be complied with.

1.2 Booking must be for a minimum duration of 2 nights.

1.3 Bookings cannot be accepted from persons under 18 years of age. The party leader must be at least 18 years of age at the time of the booking.

1.4 The maximum number of guests per Property is illustrated in the room occupancy details on the website. Under no circumstances must more than the maximum number of persons stated stay at the Property. Group bookings of single sex parties must be declared at the time of booking (additional safety deposits may be required).

1.5 No bookings are valid until confirmed by us in writing.

1.6 Once a booking is confirmed it is not subject to change. If you choose to cancel, see section 11 for details of the terms that would apply. Whilst we will be under no obligation to do so, we may in certain circumstances, make minor adjustments to bookings. In these

circumstances we will charge £20 to make the change.

Prices

Prices listed on the website are quoted in pounds sterling. Payments can be made online, over the phone using a debit or credit card, or by digital bank transfer.

Deposit

3.1 If the holiday is due to commence more than 6 weeks in the future, a deposit of 25% of the cost of the holiday ("Deposit") must be paid upon booking. If the holiday is due to commence within 6 weeks, the full balance must be paid upon booking.

Insurance

4.1 We recommend that Holiday Insurance is taken out when making a booking.

Balance Payment

5.1 Once a booking is confirmed, the full balance must be paid 6 weeks prior to the holiday commencement date and we reserve the right to cancel a holiday where payment has not been received 6 weeks before the commencement date.

Owner's Responsibilities

6.1 We will make every effort to ensure that the descriptions relating to the Property on the website are accurate and complete. We will, as soon as possible, notify you in writing of any changes to the description of the Property which would make our descriptions of the Property inaccurate, incomplete or misleading.

6.2 We will ensure that the Property is vacant and that you and your Guests have access to the Property for the full period of the holiday rental.

6.3 We will ensure that suitable arrangements are in place for you to collect and return the keys for the Property.

6.4 We will comply with all laws and regulations applicable to the Property, its contents, services and facilities.

6.5 We will respond promptly to any queries or issues which may arise during or after the Holiday Period and use our best efforts to resolve them.

6.6 We shall have no liability for any personal injury or death unless this results from our own negligence.

Damage Deposit

7.1 A damage deposit of £200 must be paid at the time the final balance is paid. This will be refunded in full provided that the Property is left in its original state, see section 8.

Holidaymakers' Responsibilities and Forfeiture

8.1 Holidaymakers must ensure that the property is suitable for their requirements prior to booking. For specific requirements relating to accessibility, the Owners should be contacted for clarification before a booking is made.

8.2 The Holidaymakers shall keep the Property and all fixtures, fittings, furniture and effects in, on or at the Property in the same state of repair as at the commencement of the holiday. The Property shall be left in the same state of cleanliness and general order in which it was found. We reserve the right to deduct a reasonable charge from your damage deposit for professional cleaning as may be required to return the Property to its original state of cleanliness and tidiness.

8.3 The Holidaymakers acknowledge that personal belongings and vehicles (together with their contents) belonging to you and your Guests are left at the Property entirely at your own risk.

8.4 Guests under the age of 18 must be supervised by an adult at all times during their stay.

8.5 The Holidaymaker must report and pay to the Owner the cost of any damage or breakages made during their holiday occupancy.

8.6 The Holidaymakers' right to occupy the Property may be forfeited without compensation if:

8.6.1 More people or pets than declared at the time of booking or before the commencement of the holiday and/or the number the Property holds, attempt to take up occupation;

8.6.2 Any illegal activity is undertaken, or activities which may cause unreasonable damage, noise, behaviour or disturbance; or

8.6.3 Any of the Holidaymakers smoke inside the Property.

Use of Hot Tub

9.1 The Holidaymaker must adhere to strict rules and regulations when using the hot tub provided with the Property. If the hot tub is required to be shut down, drained and re-filled due to Holidaymakers’ misuse, an additional cost of £100 will be incurred.

9.2 The following terms apply:

9.2.1 A maximum of 4 people will use the hot tub at any given time;

9.2.2 Guests must shower before using the hot tub;

9.2.3 Guests must refrain from using moisturiser or fake tan prior to entering the hot tub;

9.2.4 The hot tub must not be used by a single occupant at any given time;

9.2.5 Guests must take care when entering and exiting the hot tub, decking may become slippery;

9.2.6 Guests must not use glass near to or in the hot tub;

9.2.7 Guests must not use electrical appliances near to or in the hot tub;

9.2.8 Guests must consult a physician before using the hot tub if pregnant or have health concerns;

9.2.9 Guests must not use narcotics or other medication that may cause drowsiness or affect blood pressure;

9.2.10 Guests must adhere to the recommended soaking time: 39/40°C for a maximum of 20 minutes, 36/37° extended soaking time;

9.2.11 A guest must not immerse their head under water as this increases risk of infection and heightens the danger of drowning;

9.2.12 Guests must limit the consumption of alcohol during hot tub usage: hot water may speed up the effects of alcohol and lead to drowsiness or loss of consciousness;

9.2.13 Children under 5 years old must not use the hot tub and children must be supervised at all times;

9.2.14 Guests must avoid using the hot tub immediately after consuming a heavy meal and immediately after exercise;

9.2.15 In the event of an allergic reaction, Guests must leave the hot tub immediately, rinse off in the shower and seek medical advice if symptoms persist;

9.2.16 Guests must not turn the isolation switch off or tamper with any of the jets.

9.2.17 In the event of a fault or damage to the hot tub, Guests must inform the Owners at their earliest convenience;

9.2.18 Guests must replace the hot tub cover after use.

Unavailability of Property

10.1 If for any reason we have to cancel your booking in advance due to circumstances beyond our control, for example fire, flood, exceptional weather conditions, epidemics, destruction/damage to the Property (“force majeure“) you will be refunded the full amount of the booking. We cannot, however, pay any compensation or expenses as a consequence of such an event.

Cancellations

11.1 Cancellations must be submitted in writing to us. In the event of cancellation, Guests may be due a partial refund which is dependent on when notice of cancellation is given to us prior to the holiday commencement date. The refund is calculated as follows:

    48 hours or less notice – No refund due

    3-41 days’ notice – We will endeavour to re-let your dates, if we are able to re-let, we will refund you the deposit and remaining balance. If we are unable to re-let, you will receive 50% of the sums paid within 10 working days of cancellation.

    More than 6 weeks’ (42 days) notice – the Guest's liability for the remainder of the balance will be waived or the balance refunded if this has been paid previously. The deposit will be refunded and will be paid within 10 working days of cancellation.

11.2 If you are unable to take up your booking because of Covid-19 government lockdown restrictions or imposed self-isolation then we will agree alternative, mutually agreeable dates for your stay.

Pets

12.1 Any pets you intend to bring with you should be authorised by us before booking. Dogs will be subject to approval based on size and breed.

12.2 The following terms apply:

12.2.1 Dogs must be under strict control at all times while in or at the Property;

12.2.2 Any fouling must be cleared up without delay;

12.2.3 The dog owner must bring a bed or basket for the dog to sleep in;

12.2.4 Dogs must not be left alone in the Property at any time;

12.2.5 Dogs must not lie on beds or furnishings;

12.2.6 Dog owners must ensure that their pets are free from parasites and fleas before they enter the Property;

12.2.7 Any damage is to be reported immediately. Any additional cleaning required, that may incur an additional charge, will be at our discretion.

Arrival and Departure

13.1 Holidaymakers may enter the Property after 3pm onwards on the day of check-in.

13.2 Holidaymakers must exit the Property before 10am on the day of check-out.

Owner's Access to Property

14.1 The Owner shall be allowed access to the Property at any reasonable time during any holiday occupancy.

Communication and Data Protection

15.1 We may as part of a booking introduce Holidaymakers to the goods and/or services of third parties. We shall not be treated as an agent for any such third parties, and any contract for the supply of such goods and/or services shall be between the provider and the Holidaymaker.

15.2 We treat any data collected during the booking process in strict confidence.

15.3 Personal data will be processed fairly and lawfully in accordance with the Data Protection Act.

15.4 Personal data will be kept only for as long as is necessary for the specified purposes.

16. Legal

16.1 Any dispute or claim which may arise in relation to your booking will be governed by English law and you agree that any dispute will be dealt with exclusively by the courts of England and Wales. The Booking Conditions will apply to all confirmed bookings, and these Terms and Conditions supersede all previous editions.
